The local bike shop gave out our personal information to a dangerous relative that we've been hiding from for 6 years. Now he is now harrassing us by calling and threatening to "visit". Is there anything we can do? Does a business have the right to give out a customers home and cell numbers along with address?

You could sue them for damages, but the likely hood of them having very much to pay you is slim to none. Change you phone numbers and report the harasser to the police.

A business does not have the right to give out personal information to anyone without the persons consent. If you did not give the bike shop consent to give out your personal information, you need to hire an attorney and take the bike shop to court. You should also seek to get a restraining order to protect yourself and family from your dangerous relative.

Keep a record of his phone calls. Buy a recorder from an electronics store that plugs into your phone line (check the laws of your area on recording phone calls first) Record all of the phone calls, make a copy for the police and keep a copy for yourself. If he is sending you letters, save them, make a copy of them and turn the letters and the phone recordings over to the police. Keep a record of everything he does. That record will come in handy incase anything happens.

I'm sorry for your situation and I hope that it is resolved peacefully.

no, you should get a good lawyer and sue that business. make sure you can pin down exactly who in the business gave out the info. some stores can always say the employee does not work there anymore, thereby absolving them of fault.

No, however there isnt much recourse you can take. Was it a mom and pop shop? I bet the relative gave them some sob story to get the info.

He doesn't have a "right" to give out your contact info, but nor does he have a "duty" to keep it private, UNLESS you had some sort of contractual agreement that said so.

No they do not. But it's difficult to recover damages for release of information.

That is strictly illegal on a state and federal level. Get proof and sue them.
