I recently was eating a sandwich at a national company when I bit into glass in the sandwich. I called the company and they said keep the glass they will investigate it. A few days later I got another call and the man offered me free sandwichs. Needless to say I was not happy. I guess my question is do I have a good case to sue and for how much. I did not get cut, but I did hurt my tooth when I bit down on it....

In 2007 the Los Angeles Appellate Division the Judges affirmed (agreed) with a lower court's ruling that a worker who complained about being denied 22 meal periods should face fines of $20,000; this is the government sanctioned punishment for a worker exercising his lawful right to a meal period and to be free of retaliation. Also in 2007, in a labor case against law firm Charleston Revich and Chamberlin the firm's attorneys have been found guilty by the labor commissioner of failing to provide meal periods to a worker; the firm's lawyers' admit the practice is widespread among law firms. Other workers at the firm are also entitled to damages if the labor commissioner enforces the law. Similar complaints are pending against companies SulmeyerKupetz, Kaye Scholer, Chosen Few, Loeb and Loeb, and others for denying meal periods. Why does violations and intentional negligence by big companies continue to happen? Because the fines should be much larger like $1,000 per occurrence. For you as the individual, to fight big business look at the totality of your life. How much will you spend in time and money to either get your damages or make a moral point? The worker above who has to pay $20,000 and loses time and money over a four year period hardly thinks it was worth his time to complain of not getting his rights. The second worker was awarded a very small sum, which is hardly a deterrent to a company that has a million dollar insurance policy. Fight, fight, fight, but is it worth it? What are you willing to pay? Unfortunately your rights to be compensated for damages are not absolute nor guaranteed in this so called democratic, capitalistic society.

Instead of asking this on Yahoo Answers...you should be talking to an attorney!

The sandwich offer is to "make amends" which I would consider being a "payoff" if accepted.

As for how much you would get...that's determined by the laws and the court. Was there "intent" to put glass in the food product which could result in punitive damages and what your medical expenses would be.

Talk to an attorney...get good advise...and go from there!

You could sue for damages or take out an injunction against the company which would hopefully permit the court to lay out an order against the company to cease any negligent acts performed under working conditions, basically you'd be fighting to make their standards higher. But you could also sue for negligence. The pain you had suffered could have been worse than what you had received... I recommend you speak with a solicitor.

first piece of advise. never take legal advice from a cop 30 years as a cop tells u nothing bout the law they pay off language is so dumb i almost doubt he has been a cop for 30 days o wait no i dont.
did u save the glass? hospital pain suffering or just whining
if wining take the sandwiches and shut up

You did not say if you needed medical attention. If you did, they should be responsible for your medical bills plus pain and suffering.
If not, I doubt that you have a case.
