One twin was born on December 31st at 11:59 PM and the other twin at January 1st 12:01 AM? Would the twins be a year apart or would they just ignore it?

Birthdays in different years, but still only minutes apart. Now the first born does get rights (Legal ) as applies to the oldest child. They will have fun with the year issue though.
