How old are they? What is her lifestyle now? If they are not at least 13 and she is not a danger to them the courts will always suggest they at least visit. That does not mean she will get custody. Give the mom a break. Let the kids make their own decisions on their mother. Raise a child so you will not have to HEAL an adult! Good Luck!

You probably got them to begin with because she abandoned them, right? Dont worry. Five years is a long time. She may through courts get supervised visits, but I wouldnt even worry about that after 5 yrs!
I have been hearing the last several days on Y/A a lot of women who dont have custody!

If she hires a lawyer and fights for them is the only way she can gain custody. She really has to find something that makes you an unfit parent. With her being absent in thier life will only look bad on her.

That depends upon the state as well as the judge presiding. Some judges still feel that a monther is better at child rearing than the father and if she gets that type of judge she would have a very good chance.

Talk to a lawyer.
Things that affect the decision:
- why did mom lose custody?
- who has custody and what kind of custody is it?
- what quality of father can dad be proved to be?
- what quality of father can mom be proved to be?
- what are the local city/county/state laws that apply?
The last thing considered after those is what the kids want.
Talk to a lawyer - someone whose legal advice is authoritative where you live.

well my ex went to prison for 9 mths.i thought i had costudy automatically.well when she got out she waltzed right back into the house,got costudy of the kids and got the house and i had to pay c/s.there was nothing i could do about it.your best bet is go to the courts and try to get full costudy now.or you could end up like me.

she might come and try but I wouldn't worry about it. You should document things she does now in case you ever need to present it at a future court hearing.
