If you were awarded the title in the divorce he HAS to turn it over to you. Then you take it to DMV after he signs off on it and have yourself put on it. Keep in mind that you will also have to get your own auto insurance I suggest you start looking BEFORE title is turned over, also have the car checked out BEFORE he turns over title so that if anything needs to be done you can have your lawyer request all repairs be made.

A judge would order him to sign over the title to you. He can't refuse. Call your local Dept. of Motor Vehicles and ask them what kind of documents you need to bring in to get this done. They deal with it all the time.

He has no choice if you were awarded the vehicle. Have your court order along with you when you go to change it over. He can be thrown in jail for not going to change it over to you. Good luck.

You can get him for contempt of court if he doesn't turn it over. But have your lawyer get it and you can pick it up at his or her office. Then go to the DMV with all of your papers, and they'll change it over.

If it's in the divorce decree he has no choice. He does however have to sign a quit claim deed.
