he filed unemployment, they denied it because his employer said he quit, he fought it, then his employer said he was fired, the unemployment called that "just cause"..how rediculous, he should fight it again, right?

It is in ohio. And no he wasnt givin a slip to take to unemployment...it doesnt work that way here.

Depends on where you are in your fight. For the most accurate answer you should contact an employment attorney who is licensed in Ohio.

In looking at the Ohio website for unemployment, they are structured similar to Illinois. In Illinois the person seeking unemployment benefits get ONE and ONLY ONE real opportunity to fight for his/her benefits. That is at the appeal either on the telephone or in person, before the hearing officer. In Ohio as in Illinois that hearing officer is an Administrative Law Judge.

In the hearing before that person your husband has/had an opportunity to present his case in accordance with the current Ohio Laws, cross examine the employer, and make a legal closing argument. See why you need an attorney? That hearing is the only place to do these things.

Ohio, like Illinois allows a person to appeal the decision of the hearing officer, but that appeal is to a Board/Commission. In Illinois that means a legal brief that cites both precedent cases and appropriate statues. In Illinois we cannot add any facts to what was brought up at that telephone/in person hearing.

I found this info on Ohio at pages 21-24 on the brochure that can be downloaded from the unemployment site.

Just keep encouraging him to keep continuing forward. At least you guys are together that is what matters the most but you both need to be willing to work this out together. Keep being positive, that is the key to his depression you may also might want to think about getting him meds so he can think through all of this with a little more help. Times are rough right now for a lot of people just remind him of that. There are so many things out there that can help you guys and this situation he can get paid by the government for being laid off he will get paid half of what he was. Just be sure you stress the fact that you are together and that you can make it through anything that is the best thing you can do for him and just listen to what he has to say. He may be experiencing many feelings such as regret, failure, anger, depression. You will want to watch him very closely for awhile just love him and let him know you love him hopefully that helps. He is probably out of appeals. What was the reason the company gave? There are a number of things that can be considered as quitting or being fired for just cause - for example if he didn't show up for work when he was scheduled to.

He needs to find another job.

I agree that he should fight it!!..Didn't the unemployment office notice that they changed from him quiting, to being fired???
Just curious, but what state is this...sounds like ohio...

Go ahead and appeal, but don't wait for unemployment benefits. Get the old resume ready and hit the pavement.

He should talk to an attorney to see if he has a case they can advise him best. Or the Labor Board in your state may can help. I'd check the attorney first though.

I wouldn't waste any more time on this -- he simply needs to hit the streets and find another job. Let it go.
