I know someone had an accident, they had a new clutch and garage didn't put oil in the gearbox. Few days later he spun his car and crashed into fence.

My mate told me the reason it happened, cause there were no oil in the gearbox and while he was changing the gear round the bend the driveshaft on the left locked up and the tyre burst then the car spun round facing toward the way he came.

He found out there were no oil after the accident and there are no slight of leakage.

you would notice a horrible smell, the gears would overheat and probably weld to the drive train.

Jackanory.
Why would the tyre burst ? you can skid from 100mph to a stop and all that will happen is a flat spot so either the tyre hit something or was faulty
Most front wheel drive cars you have to remove driveshafts to replace clutch, so yes oil is removed and replaced. Although you would have to be incompetent not to refill gearbox.

If there was a catastrophic failure in a car gear box, it is possible but very unlikely for the car to spin out.
The most likely thing that would happen is that the gear box would explode open.
I think this is a bit of an urban legend.
Ja.

If there is no lube in the rear end the pinion and gears will lock up causing the drive shaft to break or the tires to skid.

You Don't have to put oil in the gearbox when the clutch is changed. The gearbox is removed intact. When was the last time your mate checked the gearbox oil????
