well i have to read the chapter for that one.
But the context of what you are stating is this, One day a week it was commanded for the Israelites to get together. That was the time when Moses was to "preach" to the people of Gods requirements. this was the sabbath, as you know, they were in captivity for 400 years due to the fact that they did not honor the sabbath before Egyptian captivity.
So It was an act of disobedience for one,
At this time i am not sure for the reason of the number 43 stones, may be due to the above statement i made, 40 years in the desert they are to wonder.

The problem is that the man was deliberately and flagrantly gathering sticks in the open on the Sabbath day when God had commanded that no work be done on the Sabbath.
This was a direct challenge to God's authority and apparently it was the first public offense against the newly revealed law of God. It was, essentially, being tested. Therefore, the severity of the punishment was to demonstrate to all of Israel the necessity of obeying the Law of God.

God is also Holy and Just!
I think a lot people take out that part of who God actually is.
For God's purpose He sentenced this man to death. This showed the people how serious God was about His Laws.
These particular Laws were abolished by the blood of Christ and that's why we aren't beholden to them any longer.
Christ picked wheat on the Sabbath and healed on the Sabbath . . . The Pharisees tried to use these actions to pronounce death of the Lord for breaking the Law of Moses.
But, Jesus explained that He didn't come to destroy the Law, but to fulfill them . . . which He did.
The Law was only put in place to show the people their sin and to keep them healthy and safe until the Lord Jesus came to cleanse them of their sins and be for us all the Sacrificial Lamb of all lambs.
Even though some of the things in the Scriptures seem cruel, remember that God is Holy and His justice system is flawless and is so much better than ours that our human minds just cannot phantom it.

We in India believe that good and bad, virtue and sin/crime is because of our own action.God has created the Great Law/Dharma on which the creation is sustained.If any body violates that Law,that is bad action and he will have to reap its effect.However, God will never instigate violence/Crime,if he does so, I do not think he is God at all ,he must be a nomadic tribal!! Having said that, since you are quoting from Bible,let me hasten to add that great scriptures can not be interpreted so easily, it has multiple meaning/symbolic representation; only an authority who has studied through a lineage of scholars and practitioners alone are qualified to interpret for us.

God's ways are higher than ours.
He is perfect and just and righteous...we are not. What we think is good is but filthy rags before Him. Therefore, disobedience of any kind is sin, deserving eternal death in the lake of fire. Condemning mankind to death may seem harsh to some...they may say "all Adam and Eve did was eat a bite from the forbidden fruit." Yet, the truth is, they blatantly disobeyed God.
I suppose one day when we all see the glory and righteousness of God...some for just a brief moment in judgement...we will realize how miserably low and detestable we were as sinful man before utter Perfection and holiness. Until then, we should repent, ask for Jesus Christ to be our Savior, fear, and humble ourselves before God. In that sense, it is truly amazing how great the mercy of God is for sending His Son to pay the price of our sins!

Just one of many incitements to murder and genocide by the deranged Abrahamic god found in the Old Testament. Weird, hateful book. What's even more weird is that Christians have kept it as one part of a two-part work of fiction and fable that, for Christians, constitutes "truth."
How weird the book is is reflected in Mark 185's response: Deep denial, blind, dumb faith, and supreme apology for his own hateful god.

The bible contain so many horrible punishments and acts, that by it self is proof it is a man made and redacted book, no gods are involved in it. Immorality is the red treath woven in to the bible and those that claim to belief it.
