It was for retail theft and battery but they said I have to wait until 2009 to get the retail theft sealed and the battery can't be sealed.

Ask a lawyer about your state. The record will not be expunged, but it is possible to have it "non-disclosed" meaning that it is not visible to anyone other than police or government officials.
If they said it was not eligible until 2009 that means you are still under probation, it depends on your previous record.

It will take an "act of congress" to expunge any record.

I think what they are telling you is it will be -sealed- from public ever viewing the information , not from the authorities.

And usually has guidelines to that happening, like no further instances or charges until you become an adult.

Some people don't realize just how much more crueler the public can be, compared to the correctional system.

It depends on the state you live in. In California in the 1970s, one could have a misdemeanor conviction expunged after successfully completing their probation without getting in any more trouble.

JUST PUT THROUGH A LAW IN ALABAMA ABOUT THE SAME THING-WILL BE ON RECORD FOR EMPLOYMENT AND CREDIT REPORT FOR 3 YEARS.
