The State of Florida falls under Federal law so a creditor can take you to court and if they get a judgment, they can attach bank accounts, garnish wages (25% of your gross) and file liens on any property you may own like cars, boats, land and homes.

They can not take your cars and home, but you can not sell them either without the creditors being paid out of the profits.

Only th I.R.S. can take your Federal tax return.

That usually depends on the creditor. If the creditor is your mortgage company or car loan company, then yes...they can foreclose/repossess. However, attaching your tax return is usually something the IRS would do, or if you lose in court.

However, it is a credit card company, they cannot take anything and you have a lot more rights then most people think. Check out the article below on how to get out of debtors' hell...it will tell you your rights and how to bargain with these people and get them off your back.

Hope this helps.

I'm assuming the creditor is not the IRS. They must first take you to court and get a judgment. Then they can attach some of your assets. They cannot take your home. They cannot take your tax refund. But don't put your refund in a bank where they have a lien on your account.
