Well since President Bush has mentioned that he would like to close it, then it could be closed before he leaves office.
As far as being legal, well, that's up to the lawyers and the SC.
Personally I think most of those prisoners should have been classified as POW's and locked up permanently because the war on terror may never end.

Well, what do you want it to be? You want the Detainees to be treated as POWs by all the rules of the Geneva Convention. (Although under the rules we can shoot them were we find them.) Then you want us to try them (against the Geneva Convention), and release them (not required under the GC) and yet you want to call Gitmo a Detention Center when by your rules it should be called a Prisoner of War Camp. Since the "War" is still going strong in both Afghanistan and Iraq, it is pure idiocy to even contemplate releasing any of these guys much less closing the camp. If anything, we should be building more and larger POW Camps. I am sure we have some islands in the middle of the Pacific we can use.
Hey Kenny, try this one on. Several Gitmo "Detainees" that have been released have been killed or recaptured in fighting in Afghanistan. These guys are not a bunch of innocent goat herders and cab drivers. The military was pressured to release the least dangerous of these guys and they went back and tried (and maybe succeeded) in killing our men. Put that in your peace pipe and smoke it.

Monkey m is right hundreds of prisoners have been released after years of abuse in there without any charge. The whole world outside of America sees Guantanamo as nothing but a concentration camp .and not even one prisoner released from there has ever been found guilty of anything
not so long ago a group of Chinese who were seeking assylum in Afghanistan when they were captured by the US were released after being held for years in Guantanamo the US had mistaken them for Islamic militants .....that says it all

If the Guantanomo detention facility was legal in the first place, the USA wouldn't have placed it in Cuba. bush will close it before the end of his presidency to hide the stuff that went on there.

It'll be closed when the inmates inside are either released or charged, judged and sentenced.
