I was involved in a car accident.The citation said:conflicting story.Neither of us(the other driver and me) got a ticket.Now I am receiving chiopractic care and I hire a lawyer.I filed a liability claim against the other driver's insurance company,it is denied(I don't have full coverage).since no party was at fault from the citation, can my lawyer still collect money or is it a lost case?thank you

Ask your lawyer - that's what you hired him for.

The lawyer can't collect money until after you go to court and prove your case to a judge.

Tickets don't determine fault. Likely, they're going to look at the damages to both cars, and look at the injuries involved, and listen to both stories, and see if there are any witnesses. If they/you can't PROVE the other guy is at fault, in accordance with the standards of fault in your state, you're not going to collect anything from HIS insurance.

I have been in that same situation. What I learned is there always is a witness, you just have to look for them. Start by placing an ad in the paper asking anyone who was in the vicinity and witnessed the accident to come forward or go back to the scene and canvass the area and talk to the people who live and work in the area if they saw or heard anything.

not likely. why would they pay out when they have no proof their insured is at fault? do you want your insurance to pay out? i didnt think so.
