I was brought here bout 5 yrs ago on a tourist/visitors visa and obviously overstayed it but I'm planning on leaving, b4 i turn 18 to avoid the ten yr ban. so i was wondering is there any chance in hell i could apply for a student visa once i go back to my country? does anybody have any idea? do u guys think it is likely that i'll get denied? thanks.

As I understand the process, you need to show strong ties to your home country that indicate you will likely return to receive any non-immigrant (visitor) visa.

Yes, absolutely, you will be eligible for a student visa. As long as you are out of the country before that age of 18 and 1/2 nothing will be held against you. You'll have to qualify for the student visa just like everyone else.

Well, certainly you can apply. However, I doubt many consular officers would approve someone for a student visa who spent most of the past 5 years living illegally in the US. Doesn't mean it couldn't happen, of course, but 214b applies to students as well as tourists, even if it isn't usually applied exactly the same way. However, since you're leaving before you turn 18, the good news is at least there is no legal obligation to turn you down. The bad news is, it may not matter.

you might have to stay in your country the amount od time that you overstayedf in the US first b4 applying. you should have returned b4 your visa expired and return again (that's if you had a multiple entry visa)
