Well i havent work all year. And i have a 9 year old daughter. and we are both living with my boyfriend. and he has been supporting both of us. But how do we file this year should he file head of household with one or two dependants? or should we file married.I mean what is the best way to file with us getting back more?

You can't file as married as you are not married.

The IRS just released new rules on situations like yours.

You boyfriend should file as "Single" with your daughter and (maybe) you as dependents. I say maybe because if it is against law to cohabitate in your state, he can not claim you.

He would not be entitled to Head of Household, EIC, Child Care Credit or Child Tax Credit if your daughter is not related to him by blood or adoption but he can claim her (and maybe you) as dependents.

Well, first of all you don't just get to choose - either you are legally married, in which case you file that way, or you aren't in which case you can't file as married. If you get married between now and next Monday 12/31, you can file as married.

Your boyfriend can most likely claim you, and possibly (with a ruling that just came out changing the rules) claim your daughter, but neither of you would be qualifying people for him to file as head of household, so he'd have to file as single. To file as head of household, the qualifying person must be closely related (the IRS has a list of relationships that qualify) and neither you nor your daughter fit those rules.

Without knowing anything about you or your boyfriend's income, it's impossible to say how you should file. Fill out the forms with you as head of household and see how much you would get, then fill out the forms with your boyfriend as single with you and your baby as dependents (he cannot file as head of household). File the return that gives you the greater refund.
