Actually now using torrents is considered illegal. A ruling was passed over the summer against TorrentSpy in favor of the MPAA. While it will be in debate for some time to come. A little snippet and links to a few articles.
It's not that it is illegal to download that is perfectly legal. The illegal part is not downloading copyrighted material, but actually sharing copyrighted material.
You can download anything protected or not, but when you use P2P clients you are actually sharing those files. Which again is the illegal part. So you can download from FTP sites legally because it does not require you to share any files on your system.
Torrents are supposed to work in RAM which does not store material on drives. The hashes are loaded in RAM and that's what being shared.
"Judge Cooper took issue with TorrentSpy's argument that data in RAM is not "stored." She noted RAM's function as primary storage and that the storage of data in RAM—even if not permanently archived—makes it electronically stored information governed by federal discovery rules"

Many people claim that it is not illegal for many reasons, however, this is not the truth. When you are downloading copies of another man's work, you are taking from the revenue that they could have made. In short, you are stealing, and stealing in any way, shape, or form is against the law.
Also, there have been people caught using these torrents for illegal purposes. The RIAA and MPAA track people down every day. Don't be surprised if you get a notice in the mail that forces you to pay more than the work you've stolen.
On college campuses, there is software that tracks your web pages. This is also a place where people get caught.
That being said, it is best for you to know that being a criminal can, and eventually will, get you in far more trouble than it was worth.

The software is not whats illegal. It's downloading any Copyrighted Music or Movies that's Illegal.
There have been 2 notable case's in the past 90 days or so. 1. a woman was fined a total of $222,000.00 and in fine of $120,000.00 was awarded in another case. Both was for downloading and sharing copyright music .

Proces called "Downloading..." is legal.
Torrent clients is also legal.
Torrent files is also legal.
Movies are copyrighted and is ilegal to download them.
Music too...
Limeware is legal but downloading some "things" out there is ilegal...
Short.........
DO NOT download copyrighted movies,software,music.....

What you use the programs for is most probably illegal.
Downloading protected content *is* illegal, but like any distribution of illegal items, the distribution of the items is more likely to be penalised than the receiving. If you stop the drug pusher, no-one is buying drugs.
