my fiancees boys mom tried killing the youngest one when he was 9 mos old and my fiancee went off the deep end, he asked his mom totake the kids till he can get on his feet again and now its been over two years, SHE WNT GIVE THEM BACK! what can he do???

Frankly, it doesn't sound like either of these two parents are fit to be raising these kids. The mother tried to kill them, the father gave them to his parents and now you want them back. Do them a favour and leave them with the Grandparents. At least they have some stability. Whats wrong with your boyfriend that he couldn't get his sh*t together for over two years? This kind of stuff pisses me off! I have two kids, went through a divorce and raised the kids myself....all while getting back on my feet. I'm sure now that he has you, he will breed a few more.

Even if their grandmother does not have legal rights, I'm sure she will fight for custody and her petition will be taken seriously. She has been the sole custodian for over 2 years, obviously without incident or your boyfriend would have wanted them back earlier. According to your comments, the youngest would be at least three years old. You didn't mention how old the other boy is, but I am assuming he is in school. Do you and your boyfriend go to his mother's every weekend to spend time with the boys? Do they spend the night or weekends with their father? There is more to this story than what is being presented here.

It doesn't sound like she has legal custody of the kids. If that is the case then you should call her and explain that to her. Tell her that she is legally required to give the kids back to their father. If she still doesn't listen then you need to call a police department. On the other hand if she does have legal rights to the kids than she doesn't have to give them back. If she does have legal custody and you guys want the kids back then you would have to go to court and settle things. If your fiancee is a fit parent and there isn't a reason for him not to have the kids then your odds are good. Since he is their father he would usually get priority. Good luck - sounds like a tough situation. I hope that things work out for the best.

if she doesn't have legal custody thenhe can just go and get them but if she has them legally then he now has to petition the court for sole custody of the kids but first he has to prove he is both financially and emotionally well to take care of them. it will be a tough road so i hope you're up to it and get married soon the courts like it when there's a two parent home and not just people shacking up. it doesn't look like a stable home.

hire a family law attorney.

if the mother doesn't have legal guardianship, the fiancee can go get them.

if you two can prove that you are capable of taking care of the kids then you can take her to court and you can fight for custidy and if it dose come to it you have no other choose.
