In theory, it should be strictly based on the best interests of the child. Therefore if the father is deemed to be a more fit parent than the mother, then the father would get full custody. In reality, the courts seem to always favor the mother. Most of the time, the mother would have to be shown to be a completely unfit parent to lose custody. At least that seems to be the case in California.

Sometimes it's because the father is really a great parent (a terrific dad) especially for a boy. Children need BOTH of their parents in their lives, but the one they see the most is not always the Mom. If the child is very lucky EITHER parent would be a great person to raise him or her. Joint custody means just that...two parents sharing, and sometimes it's the Dad the child lives with mostly. Ideally the parent who the child WANTS to live with (because of school, friends, pets, etc.) is the one everyone agrees gets custody.

If they've been responsible for the kids at home -- if he does what a housewife does. Stays home, dresses them, feeds them. If the exwife is a drug addict or something like that, the man will be able to give the kids a more stable environment. I knew one man who intimidated his wife into leave the children behind. He'd brainwashed her for years and told her that she was incapable of doing anything and the kids were better off with him, so she let them stay and I felt so sorry for those poor kids. Different things can give the man the edge, but most people get joint custody so nobody is the better parent. They're both equally needed in the child's life.

it depends on how the mother is..if she has a job...if she has a house..or a car..or food! and if she abuses the child...really it just goes down to how the child is treated by each parent. The mother does normally get full custody of the child..but if she is un-fit...then the father gets it! hope this helps!

Usually it entirely depends on the parents capability to raise a child. Whoever seems like a better parent to the court will recieve full custody. That usually includes checking for any sort of drug history of the parents , what range of income each parent would be able to provide, the type of housing, ect..

There has to be many, many, many FACTS AND PROOF to do this and there are time's that even it doesn't work. Scare tactics can be done yet, it may not work.
If you know for a fact that your ex or soon to be ex-wife doesn't take care of your child at all--get yourself one heck of an Attorney and don't fall the what ifs.
I'm a mom that fell for the "If it goes in front of the Judge and you're living with someone" (when the girlfriend of the ex was staying over--sleeping on the couch) you could lose custody of your son. I agreed to things that I really shouldn't have just to keep my son. My life was better than the father's (not money) and I would have disappeared than to allow his father (and step-mom)to have custody. The two of them would have and did their best to ruin him in self confidence.
It was a major fight for many things--I gave in on some--learned to fight back on my own without an attorney.
