Can neighbors do whatever they want. I've asked her to stop watering and she doesn't, her boyfriend is now in jail for threating us after we requested they stop flooding our yard and calling the police. My yard is a mess and water continues to slowly flood my yard through a retaining wall from their excessive watering. I live in San Diego county and would like to know if the law protects homeowners againts this type of harrassment and if this could be considered vandalism. Thanks

Call your local code enforcement agency (building department, city or county level) and ask them if there is anything they can do.

Unfortunately, you may end up suing them. At the very least, the boyfriend is going to be pissed when he gets out.

Why does she continuely water? Maybe she needs to put in some kind of retaining stuff on her side so her water stays where its suppose to then she could quit wasting water. Her water bill would go down huhhh.

It might be considered vandalism but I am not sure. Contact the county/city and have them come out and do an assesment of why it floods.

Good Luck

spray thier yard with a sprayer from your property loaded with roundup!!! do it at night. then they won't have anything to water!! would be very hard to prove who might have sprayed. you never know which way the wind blows! gee, some of my roundup blew over there? hmmm!

FROM WHAT I READ, CALIFORNIA CODE:
HEALTH AND SAFETY
17920-17927
TALK ABOUT SANITATION AND PROBLEMS.

EROSION OF LAND BY THEIR FAULTY RETAINING WALL SYSTEM.
EXCESS WATER CAN BE A STAGNATION PROBLEM AND CAUSE VERMIN, MOSQUITOES ETC IN CESS PONDS.

CONTACT YOUR LOCAL HEALTH DEPARTMENT AND ASK THEM FOR HEALTH RELATED INFORMATION.

No its a civil matter not a criminal matter. You could always turn her water main off that way she cant flood your yard.

You can go to court and get a court order put in place to make them stop.
