I had an car accident yesterday night. Around 12:30am on 12/24/07. I was driving straight on Alban Rd, Springfield VA and a car pulled out of a Exxon gas station there trying to get to the other side of the road. It was a median and he had a stop sign. I didn't had anything no stop sign no yield.

The guys in the other cars pulled right in front of me, and I was not able to stop my car and slammed straight into their car.

The guys in that car were injured, so I called 911 and rushed them to the hospital, I didn't see any blood, maybe just bruises.

I was issued a ticket by the cops saying "Fail to pay full time attention" - Was it my mistake - I don't know what to do. I have a clear History of driving - No tickets ever(except for only 3 parking tickets)

Please do let me know what should I do?

i didnt hit the rear... but my car right front(the passenger side) hit the other cars driver... My instincts at time didnt work well for me so i was trying to get away from teh car as I saw the car coming from my right--- so I tried to move to my left - just to avoid him - but he kept on coming into me... I will get the police report today evening - Mayeb that will help me to know what cops think about it....

I have taken pictures of the place... Also there is a gas station next to teh incident - Exxon gas stations normally have a surveillance camera - If I get hold of that - I will be good... The cops told me that I was speeding, but i was going 45mph which is teh speed limit......

And also there was a red light in front of me after a block... there is no way i would go above 45 and stop at that light in front.... Also it was a uphill fro me and thats the reason i didnt see him pulling out of that place... or else there is no way this wud have taken place

Did you hit their car in the rear? if so, than that is the reason you got the ticket. I believe that just about everywhere there is no excuse to hit someone in the rear. Now if you hit them in the side of the car, that driver should have been ticketed.

WOW - you're in Springfield? I would have gone to Edison High School if I had not moved to Florida a LONG LONG time ago....I lived up there for my entire childhood.
Anyway, that's beside the point. If you didn't have a stop sign, I don't understand why you were ticketed. You should call your insurance company -- they'll hire an attorney for you to represent you under your policy - that's what insurance is about. Lots of people have accidents - hence, the word "accident" -- if there is any lawsuit, it is filed against you BUT it's really your insurance. Don't worry, it happens all the time -- I would attempt to fight the ticket though - go to the hearing rather than pay it right away. As a rule, if the cop issuing the ticket doesn't show up, you will win...plus you can explain where you were and that there is no stop sign there -- you may want to go take pics of the area proving no stop sign and take to court with you.

Cars pulling off of private property should normally wait on oncoming traffic on a road they wish to enter. From your description, it sounds like the other party is guilty of "Failure to Yield Right of Way", and the cop goofed. Of course, if you said the wrong thing, he may have thought you admitted to not paying attention. Like on the old Dragnet series, "Just the facts."

Fight it. Check with a lawyer, but it sounds like They ran a stop sign, entering traffic from a parking lot. Two counts. You should not be found at fault at all. And you might just be able to sue the cops to pay your lawyer, too. Who knows? We live in a nastily litigeous world, so you might just be able to win that, too.

Get a lawyer.

Barring any other evidence (witnesses) I'd say you have a decent chance in court with this one. Sounds like you had command of the road at the time of loss and it was incumbent upon the other driver to yeild to YOU vs pulling into oncoming traffic.

Usually people who actually show up in court are listened too, if you told the cops that story, you can probably tell the judge and they may lighten the charges or maybe even remove them off the record if you pay. It usually turns out good if you make sure to make it to court.

If I'm knowledge this proper it sounds such as you have been pulling out of a carpark to show left onto a freeway. The freeway is four lanes on each side. The two lanes of visitors closest to you, heading the reverse manner of the way in which you have been turning stopped to allow you to pull out in entrance of them to show. The girl that hit you used to be visiting within the third lane over (out of the four lanes that you simply have been crossing in entrance of to show)? If that is the case than you're at fault. The girl that hit you had the proper of manner. Even despite the fact that the two lanes of visitors have been waving you on, you continue to didn't have the proper of manner. Fight it. Go to the court date that it says on the ticket. It shouldn't be your fault, but all states have variances on accidents and whose fault it is. You don't want to be stuck with it. If you do, you'll have to pay for their car, along with their medical bills.
