Several parts to that question.
First, are you in an area where prostitution is legal? If not, then whether or not you pay for it, you are already outside the law.
Second, what will you videotape? If we are talking naked and full contact sex, many areas consider possession of such tapes illegal.
Third, are you sure she is over the age of consent? If not, you just gave cops evidence of statutory rape, regardless of consent or pay status.
Fourth, by videotaping, you essentially VOID any possible right to privacy that MIGHT have applied to consenting adults in private.
Fifth, unless you negotiate the terms of use of this putative tape, she has rights to manage her own image. If you pay her for the right to use those tapes, that would legalize the parts where y'all aren't doing the horizontal dance. But as noted above, the twenty-toes game might still be legal. (You know the 20 toes game... 10 toes up, 10 toes down...)

If you rob a bank and you video tape it, is it illegal! Stupid question dude! Why would video taping any illegal activity for some reason make it not illegal? Your video taping any illegal activity only gives the police extremely incriminating evidence against you which will be used against you in court. Sorry but you seem like a real idiot!

As long as you obtain a release from everyone who performed in your film, and as long as you are where it is not illegal to buy a hooker.
But, with all the many potential pitfalls of such an occasion, I would still have to say that it would be a very stupid thing to do.

You can't video or sound record someone without their knowledge. If she knows and gives her consent, go for it. But, if your intent is to sell it, you'll need a release statement with her signature on it, giving you permission to use her as a model / actress.
