I traded in a car and bought a new truck from a local car dealer. I bought the truck on Nov. 10 and the car I traded in has not been paid off as of today December 24 and they have sold my old car. The trade in was financed and they keep calling me for payment since the dealer has not paid it off. I have called the dealer and spoke to the manager and their accountants, they both say this is normal. I have bought other vehicles and this has never happened before. At this point, I just want to turn the truck in back to the dealer and walk away with a lesson learned. What are my options?

SOMETHING THAT WORKS...REALLY WELL IS TO HAVE THE BANK THAT IS HOUNDING YOU GET IN COMUNICATION WITH THAT PARTICULAR DEALERSHIP...LIKE THAT YOU ARE OUT OF THE LOOP...AFTER ALL YOU SIGNED THE TRADE IN OVER TO THE DEALERSHIP...AND ON THE PAPER WORK..THERE IS THE DATE THAT IT WAS DONE..THE MILES THE TRADE HAD...AND ALSO A TEN DAY PAY OFF...ANY DIFFERENCE IN THE AMOUNT OWED TO THE BANK IS OWED BY THE DEALERSHIP!!! IT IS THEIR FAULT FOR NOT HAVING PAID OFF WITHIN 10 DAYS !

If they are asking for the next paymen and it's due or overdue, just pay it, either way, if what you paid and what the dealer is going to pay is more than the bank will refund the extra money to you.

Call the dealer again, and ask for a copy of the check they wrote to your bank. Also tell them that since it took so long and you were under the impression it was to be paid in Nov. that if there is a late fee, they are responsible.
This does happen from time to time, not at my dealer, but i hear it happens, so nothing really to worry about, just make sure you keep up with those payments no matter what.

When you traded your car in to the dealer, there should have been a title transfer. In which case you are not liable for the payments on your old car. The new title holder now has the onus of paying it off.

same thing happened to my brother
he traded his bmw coupe for a golf gti
but the car dealer didnt pay the finance off for a full month (he even got a letter from them demanding the payment) but we hasseled the hell out of them until they payed up

have you got a receipt saying the car is no longer yours !!!
have you give the logbook and v50 documents to the dealership yet (if you havnt dont )
contact the office of fair trading and the cab
write a letter of complaint aswell send it recorded delivery so you have proof of delivery

you cant have your truck back im afraid the 30 days cooling off period is up

if all else fail get a solicitor involded
