i am going through a daforce, here is the kicker. i cant get her out of the house and i am the only one whats on the note. she is running late on the payments and has killed my credit. she put a restring order on me and said a whole bunch of things that arnt true, i pay my chils support on time and every time wich is 1400 a month, she got rid of all my guns and hunting clothes. got rid of my lap top, i cant see my kids, they think i just left them, can the judges see through any of the bs. or do we just count on being done wrong? how can i get her out of my house so i can sell it?

Before I answer I really have to ask...if you are the only one on the note, why is she making the payments? Why would she put a restraining order out on you if there were no reason? Do you have receipts to prove you have been paying child support?

An attorney will expect answers to those questions and would be the best bet to make sure you are being fairly represented. Judges these days do not automatically side with the mother "just because" any more. Father's rights groups all over the country can also be a good resource for you to look into.

Something you both need to remember: your relationship's failure is not the fault of your children. The problems between you and your wife are not their fault. There are two adults that are no longer in love. Never lose sight of the fact that children are innocent victims in this process. Try to leave the animosity between each other out of the room when they come in. They are not game pieces to be used to hurt each other. What is in their best interest may not be your idea of fair.

You evidently didn't have an attorney or not a good one. I lost two houses and everything I owned twice, then this last time, I got a good attorney and made out pretty good. You need to go back to court.

Talk to your attorney about it immediately. She can't withhold visitations from you, period. If you have filed for divorce, you can actually call the police on her for being in YOUR home. If she isn't even making payments- I say kick her out. Change the locks, etc.

Talk to her and tell her that you don't like all what she is doing and your finaces and not that strong that you can take care of your self and her so just go open up and talk to her..........otherwise your situation will be worsend........
