I was skating at the local mall garage and the security gave my friend and I a trespassing order. We were longboarding trying to carve down the ramps, which sucked and now I regret even going there.

Now, what is this trespassing order and does it prevent me from going to this mall? When is it lifted and is it considered a felony? Will my college hear about this?

A trespassing order is a notice that if violated renders you subject to penalty for "defiant trespass." You may use the mall for shopping, but you may not use it for skating.

Definition of "defiant trespasser" 18 Consolidated Penna. Statutes, § 3503 (b) Defiant trespasser.--
(1) A person commits an offense if, knowing that he is
not licensed or privileged to do so, he enters or remains in any place as to which notice against trespass is given by:
(i) actual communication to the actor;
(ii) posting in a manner prescribed by law or
reasonably likely to come to the attention of intruders;
(iii) fencing or other enclosure manifestly designed
to exclude intruders;
(iv) notices posted in a manner prescribed by law or reasonably likely to come to the person's attention at
each entrance of school grounds that visitors are
prohibited without authorization from a designated
school, center or program official; or
(v) an actual communication to the actor to leave
school grounds as communicated by a school, center or program official, employee or agent or a law enforcement officer.
(2) Except as provided in paragraph (1)(v), an offense
under this subsection constitutes a misdemeanor of the third degree if the offender defies an order to leave personally communicated to him by the owner of the premises or other authorized person. An offense under paragraph (1)(v) constitutes a misdemeanor of the first degree. Otherwise it is a summary offense.


My answer is: no, it won't keep you from going to the mall to go shopping. However, if security catches you skating again, you are likely to be prosecuted. No, your college will not hear about it.

A "no trespassing" order is an officially recorded warning not to go onto a particular piece of private property. Trespassing is a misdemeanor and the property owner is free to ban you from the property for life if he so chooses, and that warning simply means not to go back there.

Trespassing is a felony and this might prevent you from entering the prohibited areas again.
