You could but probably won't win.

H1 Visas have allotments, often by countries. There are some general rules about when someone can fill a position with an H1 (or other class) versus a US Citizen. The notion is that there should be some skill not available.

Many companies can get around the rules, however, because the population of immigrents on H1 Visas are very low in percentage to others doing the job that are citizens. As such, there are arguments made around diversity of workforce that foreign workers bring etc... that allow it to go on. If the overall percentage of workers in a specific area are very high compared to others in that same area and there is a demonstrated supply that is available and going un-tapped, there's probably a case to be made. I'm not sure the protocol for that, i.e. who would care enough to pursue.

Hope that helps.

Not really legally, these people are hired because they pay them a fraction of what you make. That's the bottom line.
But you can be an instigator.. In front of them brag about an expensive luxury item you have and expensive cars and restaurants even if it's not true. This will bring the monkey out of this person and he eventually will demand more money and no one wants to pay these guys much, there not worth it.
