My mom and I will be going to the U.S. soon, and my dad isn't coming with us. We need to make an agreement letter and to have him sign it so we can cross the border. What do we write?

We're from Toronto, Canada, and my mom's coworker told her that we need both of the parents' consent in order for any one of them to bring their children over to the U.S., or else it would be considered as kidnapping.

This is a good idea. While not an absolute requirement it could help prevent any delays at the border.

Title the document "Letter of consent to travel". Have the father type it up and sign it. It just needs to say something like..."my spouse has my consent to travel with our minor children (A, B, & C) from Canada to the U.S. entering the U.S. on aprroximate date of X, and returnign to Canada on approximate date of Y. Have him sign the letter and get it noterized.

p.s. There is a 99% chance the lettter will not be looked at by anyone at the border, but it could be helpful on the slight chance any questions come up.

If you are a minor you are not allowed to exit the country without the consent of both parents. They will not allow you out of the country without the form. It is not a simple letter that you can write on a napkin, it is a proper form that must be filled and signed by the parents. I signed one for my daughters but do not know where the form was obtained. I would expect you can download it from the Canadian Government website.

If your parents are divorced the court order probably restricts how far they can take you without the others consent.

In California it is a standard. May be in Canada too.

I have never heard of such a letter. Can you give more details on what country you are from and why you are being asked to write this letter? I'd love to help but I have no idea what you're talking about.

You don't need a letter, especially since you can speak and answer the border officer's questions. All you need is proof of citizenship (a birth certificate or passport), and proof of identity (a passport or government-issued document that has a photograph of you on it, such as a driver's license).
