I have a complain against my previous houseowner for cheating and being dishonest.he is not paying back our deposite as agreed on paper...........we have vacated the house after completion of 11 months staying in his house ,we have paid our rent regularly ,he promised to pay our deposite before 15th of december ,but till now he did not keep his promise ,we went to see him many time from our new place which is very far also ,he keep telling us come next time and next time.......these days when we call him he is also not picking up our call and his relative gives excuses and telling us he is out of station or went to somewhere etc .when we call his mobile he did not pick call or switching his mobile off or making it not reachable etc,please help us what we can do now,we are not local here ...we have no support here ........

First of all, you as renters have the most rights. Tell him your going to take him to small claims court to recoup your deposit. That should bring him around. Just so you know, small claims court is cheap to file, in my area $25, so if he doesn't respond, file anyway.

Read your lease and make sure you did not violate it in any way. Once you have established that research the Landlord Tenant Law in your State and see what it says about returning the security deposit.

Once you have established the correctness of your complaint to your own satisfaction take your former landlord to small claims court. Go with all your documentation and more than likely the judge will order the landlord to return your deposit.

In Florida there are time limits and procedures that must be followed. The landlord must sent the former tenant a registered or certified letter saying he is withholding certain funds from the security deposit for xyz reason. If it wasn't sent in that time period the landlord loses his rights.

Your State may have different laws that is why you need to research them. Then take the Article number and all the legal wording with you to court.

If it's on paper take it to your local magistrate. You might have to pay a little to have a suit filed...but not too expensive. Make sure you have everything you need for the hearing. Example: proof of rent being paid on time, your lease, the signed paper saying that you will get your deposit back ( which should actually be in your lease), make sure that you did everything that you were suppose to according to the lease agreement. Don't waste any more time calling your ex-landlord....he could get you for harassment....Go file!

Small claims fee is $65 here but if you win you can recoup that too. As I understand it, just because you win, there is no guarantee that they will pay. There are laws in Texas that require a deposit to be returned within a month of the tenant's departure. You might want to check into that.
