Well the magnetic North Pole is located in the Northwest Territories of Canada. The "true" North Pole (90 degrees North latitude) is located in the middle of the Arctic Ocean so it is International waters. The Northernmost land with people living permanently is Svalbard which is subject to Norwegian Laws and Government.

Your Right, both Canada and Russia claim to have sovereignty over the North Pole. In reality though, I think both of those countries and many more, years ago signed an international treaty to leave it belonging to no one country, but to everyone in the world.
