If there was a will, your job to see all the debits are paid, taxes if any are settled and bequests and distributions are made; and account for all sums at a total accounting. YOu can charge a small but reasonable fee depending on the state you are in ; and you (the estate)may hire an atty for assistance to be paid by the estate.

If there is no will, there will be in your state a specific total of the assets left over when the debits are paid as to who gets what. Start by talking to a probate clerk on Wed.

You are the personal representative of the estate. Your duties are to marshal all assets, liquidate assets as necessary, pay all debts and claims against the estate, and make distribution to those named in the will (if you are administrator c.t.a.) or to the intestate heirs if the decedent died without a will.

If the decedent had minor children, the court would arrange for a family member to become guardian of the person of those children. In the instance where there is an estate distribution to minor children, in many states a court-appointed guardian of the estate of the minor children would be commissioned to handle their finances until they become of age.

Best advice to you is that you should work closely with a good probate lawyer to help you in the administration.
