Can my fiance adopt me so he can claim me as a dependant on his tax return. He provides more htan half of my support, all of it actually
but i made more than 3400 that year with my internship and i am a full time student. If he is my parent and i am under 24 and make more than 3400
they can claim me as a dependant, so if he adopts me can we do that?


I KNOW THIS SOUNDS WEIRD BUT WE ARE TRYING TO FIND SOME TAX LOOPHOLE!

The problem is not my taxes but his. How is it fair to support me and pay high taxes when if he was a parent he could claim me? My parent is on SSI-does not file taxes and has not supported me in years. They would not care if i am adopted, i am over 18. I am 23 he is 29. we just get the royal tax screw b/c i am not his child.

Didnt woody alan marry his adopted daughter. I am just saying,... we arent doing this for some weird pervesion, the thought just came to me when i read the dependant tax laws.

No one claims me and no one can. My mom does not file taxes she is on SSI. I lived alone and made more than her since i was 18.

the tax law actually says you can claim certain people as qualifying relatives "except if that relationship is illegal where you live"

but no, he cant claim you and you do your taxes and get your refund with the EIC and you'll be ok.

Based on my reading of the IRS rules for dependents, you may actually have found a loophole. However, I'm not a tax professional. You should verify it with a professional before you do anything.

Before you start celebrating, there are two other things to consider.

First, adoptions are not free. Actually, they're often quite expensive. The value of an exemption is $3,400 in 2007. Can you do this for substantially less than $3,400? (I doubt it.) If you can't, then, then there is no value to it.

Second, adoptions are not fast. They can take years to complete. You can only be a dependent until age 24 if you remain a full-time student. You say that you're now 23. Unless you live in a state where things move at a lightning pace, you'll be over 24 before you get through the process, assuming that your state authorities will even approve this. I know several people who have adopted and it was a very long process for all of them.

Should he adopt you he would then never be able to marry you and in virtually all states your relationship would be incestuous.

If you made over $3,400 he cannot claim you as a dependent. Period.

In fact, it's very possible that YOUR parents can STILL claim you since the ONLY support requirement for a Qualifying Child is that you provide less than half of your OWN support. Support provided by a 3rd party doesn't count as self-support. If you are considered as being away from home for the purposes of attending school, you are considered to still be living in their home according to the tax laws and they only need 6 months to claim you as their Qualifying Child.

Addendum: Woody Allen did NOT marry his adopted daughter! Soon-Yi Previn was Mia Farrow's adopted daughter and Allen and Farrow never married so his relationship with Soon-Yi was never that of adoptive father OR step father. Had he and Mia Farrow married, things would have been very different from a legal perspective, but it was not incestuous under the law.

Do you still plan on getting married? If he adopts you then that will be a bit weird.

I am all for looking for ways to have the tax law work for you, but think this is not one...plus...you have a week to finalize an adoption and your parents, if they are still around may have something to say about someone else adopting you.

If he adopted you, he could then be charged with incest if you're living together, and he wouldn't be able to marry you later since you'd be his child - doesn't sound like a good tradeoff to save a few hundred dollars in income tax.

The short answer is GET MARRIED.

Unmarried, your parents can claim you.
Married, he can claim you.

If you are under 24 how much could you possible owe in taxes anyway?!?!?!?!!
