Yes. And America has tried people who did it for war crimes.

No question, except: is America going to use torture? IMO, it would be a HUGE, HUGE mistake and would hand our enemies an incredibly powerful propaganda weapon.

Consider only how Abu Ghraib hurt the United States in the battle for hearts and minds. And now we're going to take that -- and worse -- and make it POLICY???? What absolute folly that would be.

Unfortunately, I'm sure there would be no shortage of volunteers to be torturers, just as public hangings on TV would undoubtedly draw huge ratings.

One can only hope that decency and intelligence will win this battle -- but I am not optimistic. Excuse the long answer, it is a subject that engages me, tho I feel like a rabbit watching a snake as the folly undoubtedly rolls on, to the applause of hyenas.

Water boarding is "simulated drowning" and I think the example of how it is used is shown in the Mel Gibson movie "Conspiracy Theory". One of the goals of the Geneva convention in setting up rules was that both sides in a conflict could benefit knowing that their "prisoners of war" would be treated humanly.
When international red cross workers tried to visit the prisoners of war being held by the U.S.A. they were denied access to them.
The destroyed C.I.A. interrogation tapes is another "clue" that something very wrong is taking place.
The whole attitude being "The end justifies the means" is a rational that is morally offensive to many people.

As Jimmy Carter said, of coarse it is by any definition accepted as humanitarian and international law.
Now if Bush is the decider when it comes to defining tortue, I suppose he could declare hooking a car battery up to your go-nads, or carving the bill of rights on your stomach with a sodering iron as not torture, In Bush world it is not torture. He rests his case, your honor!!!
