I got in an accident and when the CHP showed up my girlfriend said she was the driver. Shes been in jail for 3 weeks and a very high bail beacuse she was charged with a felony DUI. I was actually driving but i didnt want my insurance to go up any higher then it already was. I had no idea that my girlfriend had been drinking that much. After she got arrested i tried to tell them i was the driver and they ignored me. Can i fight this in court and win?

This is the second time you asked this question, and got great advise back then - from Richard. He is an attorney! You need to talk to someone ASAP.

Did you actually tell a lie to the cop, or did you just keep silent and allowed her to do all the talking and take the fall? The latter wouldn't bring any charges against you (as the law does not require you to say anything to a cop that could incriminate you, or even to reveal any information at all to him unless asked). Otherwise, it's possible that both of you could face Obstruction of Justice charges, and some states specifically make it a misdemeanor to lie to a police officer. Either way, just call the district attorney's office and man-up to it.

Tell them you will take and pay for a lie detector test since you owe the poor girl that much./ Call the states attorneys office and explain what you said here. Shame on you for letting her take the rap. Do the right thing and keep talking until someone listens

wow she did that for you? she must love you alot.I think once she said she did it theres no turning back cause they well think your lieing to help her so best is just to bail her out and let her do her time because they might lock both of you

yes you might be able to fight this,.....you say you were driving, the police do not have a B.A.C. blood alcohol content on you, she says you were driving,....if a jury believes it, she might get off,.....it all depends on the jury, she would have to plead not guilty, you and her would need good attorneys,.....and you both would need different attorneys,.....
