Im a woman. Our divorce was final on Nov 5. He lives in KY and I live in AL with the kids. The kids are up with him right now for the Xmas holidays. We were married for 8 years. To the point: 1. He left us in May 06, to joing the Army, we had to move in with my mother cause he stopped paying rent and bills at our house.
2. He cheated with an accquantice.
3. He lives with his girfriend and her three kids.
4. She is still leagally married to another soilder.
5. I am in school, and looking for work, I have had jobs here and there since our split.
6. The kids, son is 8 and daughter is 6.
7. I think he is recording any little mistake i might make to use it against me.
Its hard out here when you've been left like that, but thats why im in school for Pharmacy Tech.

I just want to know what can I do to help build a good case for myself to show Im a great mother, I've just had to come up from the bottom since he left.

We have joint custody. I have sole physical custody and we alternate holidays each year.

If so, you will need a good attorney. Open that wallet and take her to court.

With little information I would say because she/he thinks it will hurt you so she/ he's going after them-to stop it i would try the following
1. Tell him/her he/she can have the kids everyweekend and 1 day or more during the week or any time he/she wants them-but if he/she has that kind of schedule he/she MUST show up everytime or the kids will be disappointed-heck that frees up your weekends for finding a better man/woman and getting some much needed rest-and don't act afraid!!!!
2.If he/she thinks you'll be having every weekend to spend free and clear of kids while his/hers are busy he/she might back off or you could tell him/her that he/she can have the kids all the time - if thats what he/she really wants-
3.Its an intimidation tactic-dont be afraid and/or worried-he/she won't take them away for good. Sorry about the he/she stuff but you did not indicate your gender so I was trying to be politcally correct LOL

He will have to prove you and unfit mother or vice versa to take the children. Any judge in his right mind is not going to do it simply because someone claims the other parent is not being a good and fit parent. From the second part of your question it certainly looks as though he is the one being a bad parent, running out on his wife and children not paying the bills, etc. I really don't think he has a leg to stand on. However, you need to have yourself placed as the legal guardian before sending them to another state to stay with him. You may have a issue getting them back. God bless****

Even when your divorce you have to be able to talk when you have children. Always be truthful with each other. Don't play games.
