Im planning on leaving my husband. If I took the baby and leave one day while he's at work, and he reports his daughter miss or anything to the law about me taking his daughter, would I be in trouble? i live in Ontario, canada.. anyone.. please help...

I know, but we talked and made up on numerious occasion. sigh, Im so tired because he then does the same things over again. I cant afford a lawyer. Im not working at the moment. (on maternity leave)

Two distinct issues here- leaving him/divorce and child custody.

You have every right to terminate the marriage.

He will always have a right to see his child unless you can prove in court that he's done something to abrogate this right.

I understand money is a problem for you. Try a women's group, or your church for referrals to solutions. Attorneys frequently offer a quick consultation for not much money.

If what he's done to you isn't a legal crime (adultery?) you can still file for a divorce.

Simply walking out with the baby would be a bad thing.

yes. If you take your child and leave.. you can be in a lot of trouble for kidnapping.. and.. because of this he can obtain custody of your daughter. If you want to leave him.. and he isn't abusive.. then.. talk to a lawyer and draw the divorce papers up. Now, if you are in an abusive relationship.. then.. you can file a report with the police.. and obtain the child temporarily. After that.. you will still need to draw the papers up.

Look I would say he has no jurisdiction on the child except for you guys are married and you both have legal rights. Just make sure if you leave he has his time with his daughter but go through the right channels to leave don't just runaway because that will cause problems.

I don't know about in Canada but in the US you wouldn't be in trouble no. You just can't leave the state and if you are leaving due to abuse you have to report it to the police and make a report to hide from him but you can leave here anytime and of course take your baby with you.

you need to get your finances in order and why do you have to leave the family home why cant he leave,if it gets too much for you whatever the reason is ring a refuge center for help

yes, unless your husband is abusive and you can prove that with physical evidence then no. id suggest you speak with your lawyer about all this.

dont take your daughter away from her father , think about what your daughter would want and do unto others as you would want done unto you.
