He also had already done a paternity test which shows he IS the biological father. The birthmom did a lot of horrible things and eventually her and her family paid money to remove him.

Where are you? In the US? England? You want custody? Is there a marriage involved with a 'legal' father? Does Navaro case law apply? You state 'paid money to remove him' - is this cost of court proceeding to amend or legally change the document under a state law- or are you stating bribe/illegal change/ falsification of record. Motthers age may be important- state laws on grandparents liabilities may allow them custody of minor childs offspring.DETAILS NEEDED.

He could demand that the paternity be restated on the certificate, sue for custody and a paternity test might be needed again....which he might need to pay for. His best hope is if he can document and prove his paternity and prove the horrible things she's done. I believe that at least some of what she's done is a felony, but at the very least a crime. Unless you've signed away your rights to that child or have them taken away by a court of law, your rights as the father never go away.

Name is more or less irrelevant. It is used to show the paternity, and in your case, there is DNA evidence to prove that. Custody is usually awarded to either the Birth Mother or the Birth Father, in the best interest of the child.

You need a lawyer if you want to fight the case. The above is my opinion and not to be used as legal advice.

Doesn't matter whats on paper, it's what shows up in the genes from a DNA test. This would be a matter for the courts.
