if im divorced but im not living with my ex and my son is not living with me do i have to pay child support

Of course you do, there should have been an order for support along with the divorce papers and a visitation schedule.

The fact that you're divorced has nothing to do with the fact you still have a legal and moral obligation to support your child. If you don't start paying your support soon, ou're going to be in a real bad position quickly.

You can lose all and any of your business and prfesional licenses, as well as your drivers license, end up in jail and still have to pay back support and current support.

Get on top of this situation quickly.

Amicable...well that means you both will agree to a settlement. She is going to want to remain in the life style she is accustom and expect "reasonable" child support, etc. There are charts and tables the state uses to determine the amount of child support is to be paid, based off your income. In your case, if this went before a judge and you've been married for some years, you'll probably be paying approx. $870.00 per month, per child. You'll also give her the house, a car and the furniture. At some point the child support could convert to alimony and continue for the rest of your life. Despite your intension of an "amicable" divorce, her definition of amicable might be "give me everything I think I deserve and want and you can have a divorce". It often becomes difficult for divorcing couples with children to agree on the financial arrangement. If I were you, I'd consult with a good divorce lawyer.

Victoria? As in you're a female? you are the mother but Ex-husband(father) has custody? Your question is a bit vague about all conditions but name implies as I've stated- SO, yes you can be ordered to pay child support as the court orders. Brittany Spears is paying child support to ex -husband - she has been deemed non custodial in best interests of children. Widely publicized example but it is becoming common order now for women without custody to provide some support for children. Other posters referring to Victoria as male, ex husband/ father- do you have more info or didn't you read question?

the whole point of child support is that your ex-wife is the one supporting the child right now and you as the father should have to pay money to help her.

If the court says you have to pay child support, then you have to. And they probably will.

On a side note, supporting your kid is the right thing to do. So just do it.

Yes. It is YOUR kid and you must support it.... And, you are NOT paying to your "ex", you are paying it to your child to help feed, clothe and house him.

That's what fathers are supposed to do - support their kids.
