Check the laws in your state. In my state, it is statutory rape if the girl is under 16 and the boy is 18 or over.

In UK 16 is the age of consent so no not unless he actually forced her to have sex. Having said that he is a gutless wimp failing to face up to his responsibilities so go get him use the Civil Courts or the CPA depending on what the lawyer says. She will almost certainly be eligible for legal aid

It depends on how the statute is written in your state. It probably is though, especially if you are in the US. The fact that he ran doesn't really prove or disprove any element of the crime. However, it does show that he has a guilty state of mind.
