I mistakenly filed our I-129F even before my divorce was final. Due to bad advice. We already have our NOA1, what do we do now?

just write the Service and explain that you need to withdraw, with copy of approval notice, inform them of the reasons, so that it may be documented in your file. so when you refile they already have the info. no big deal everyone makes mistakes, but you try to continue with process then yiou could have major problems. have had to do the same for other person that actually thought he was divorced for 13 years, just to find out the divorce was finalized two months after his present marriage, which nullified his present marriage.

You write a letter to USCIS stating your intent of withdrawal of the petition based on the reason of divorce with the Receipt Number.
