In Virginia it is petty theft if under $200. You can lose your license and face jail time if convicted. Gas drive offs are actually under their very own code section which allows for different punishment than "normal" thefts.

In California its misdemeanor "Theft" if the quantity of fuel is under $400 in value.
Up to a year in jail and/or a fine.

You know at a lot of stations when that happens it comes out of the on duty attendents pay? It may seem petty, but $35 out of someone's pay check whon only makes $350 a week is pretty sad.

if you do it enough it could add up to a felony. some states if you stole objects up to $250 that can be a felony. plus its not smart anyway because they have your car on camera and they know what you look like

in which state? In my state you can spend up to 1 yr in jail or lose your driver's license.
