me,my boyfriend and my toddler lived with my boyfriend's brother family in one house that we are renting,i'm the one who's providing for me,my toddler and my boyfriend and his brother & wife also does the same with his 2 kids.so we basically just put our money together to pay the rent and utilities.is it possible to file head of household and claim my child living in the same roof?

IF you personally are paying more than 50% of the cost of maintaining the household you may file as HoH. However with the b/f's brother and wife in the household with you, that may be a stretch. Most likely you won't be able to.

You MIGHT be able to claim your b/f if he lived with you all year, had less than $3,400 in gross income, you provided more than 50% of his support, he does not file a joint return with someone else, and is a US citizen or resident, and your relationship isn't in violation of the law, even an unenforced law.

You can claim your child as long as he or she lived with you more than half of the year.

If you are sharing refrigerator space, cooking and eating together, then NO. The expenses will be added up for the entire household and it's likely that no one taxpayer paid more than half of the bills, so no one will be filing as HOH.

As long as you provide over 50% of your household expenses. You can claim yourself and your child but NOT your boyfriend.
