its been about 3yrs that i've been working with my employer but still my vacation never increased...i only have 1wk(vacation)....is this legal? how does vacation pay works anyways? i'm from california....advice pls.

its legal. Vacation is a benefit. Most companies have a set schedule such as 1 week vacation for your first 5 years of employment, 2 weeks after 5 years etc.

vacation is accrued, meaning you earn so much per pay periord. For example, I am in CA and at my work I get 6 hours per pay period. When you want to take vacation, that pay is given as if you worked.

Unfortunately, employers are not required by law to offer vacation or sick pay. Historically these benefits were created as a means to "pay" workers more back in WW II when the government froze wages. It's been around ever since.

Not too surprisingly some of the best vacation and sick benefits are with the federal government. Year 1 - 3 you get 13 vacation days and 13 sick days, all the national holidays, and an optional 5/4/9 program where you work 9 days in a two week period and get the second Friday off for additional 26 days off.

Years 3 - 15 same as above except you jump to 20 vacation days.

Years 15 - retirement. You get 26 vacation days.

26+26+13+11=76 potential days off a year.

Your company sets the rules as to vacation time as in how much you get after how many years of service. the government has nothing to do with it, and there are no laws dealing with it. My guess is you will get two weeks after 5 years. Not a great schedule but it is the employers option.

You should talk to your HR department about this. It could be that you earn vacation pay, but after you have so much it expires...or you no longer earn anymore. It's legal, it's up to the company what they give you...and how long it lasts.

you should have more than that after 3 yrs you should talk to your head supervisor
