I was recently arrested for possession of narcotics with the intent to distribute. Since it was a minute amount, they just took it away, booked me and I spent one night in holding. At my hearing, I was simply given a warning and had the charges dropped.

Now, does this mean that when applying for jobs when they ask me have i ever been arrested before can I say "no". I'm asking because technically I do not have a criminal record as the incident "on paper" never happened.

Have you ever been arrested? - Yes you have.

Have you ever been convicted...? - No you have not.

All arrests and convictions go on an indivduals "criminal history" maintained by the FBI through your states Department of Public Safety.

Even though the case was dismissed...you were still arrested and as such that arrest will appear on your criminal history but show "dismissed" as a final disposition of the case.

As another respondant stated...most employers ask if you've been convicted...not arrested. As such you can say you've never been convicted.

You can also obtain a copy of your own criminal history though your state police for a minimal fee...normally around $25.00.

Most employers ask about convictions, because people realize that cops make stupid arrests all the time. If job applications ask have you been arrested, you would have to say yes. But then so has half the U.S. because cops are idiots.

Most job applications ask "Have you ever been convicted of a felony". No you have not. They don't usually ask if you've ever been arrested.
