If you're driving at a normal speed and then a bicyclist is on the right side of you and as you drive he begins to merge in front of your car. It was so close and you tried to stop but couldn't not prevent from hitting him even though you're very cautious.

Is it your fault if you hit him and he dies ?

From the description of the incident it doesn't sound as if the driver should be considered at fault. That being said, I think the the driver should be awarded several points for ridding us of another annoying cyclist!

Bicyclists are required to follow the law, same as you.

If you hit him hard enough to cause death, you were not being cautious.

If he dies, you are probably gonna be charged. although cyclists are supposed to follow the laws of the road the same as a car, you would probably have to fight this one out in court with his family.
