Couple of month of ago I was give two tickets, one for urinating in public and the 2nd one for a open container. I pleaded not guilty because these were untrue violations. The charges were dismissed with a condition. The condition was that I stay out of trouble for a few month. Meaning that after 01/18/2008 they are satisfy with the case being dismiss providing I don't get in trouble by that date. The judge made this judgment on these two minor infraction(tickets)

Now, today I was filling out a job application. One question on the application ask "do you have any criminal cases pending?". Next to that question there is two choices yes or no. I checked no, I don't have anything with respect to court appearances for any type of criminal infraction.

It turned out according to this potential employer that I have something pending because of the condition on my judgment. My question is how can something be pending if there was a judgment made?

To make it simple, your case is pending for dismissal.

What you got was a unconditional discharge means the judge lets you go with only 1 condition; that you don't have any more run ins with the law. Providing that you behave, then after the few months are over, you won't even have so much as a criminal record.

It appears you were placed on "Pretrial Diverson" which means as long as you behave during the period indicated by the court the case will be dismissed at the end of the "probationary" period.

Until then...it's still a "pending case."

The Court system is flooded with cases. It could just be that it hasn't updated your yet. Give the court a call, only way to know for sure.

What a shame... had you been able to wait until the 18th (though the Adm. side of clerks office would probably take longer then that) the job would have been yours ;-(
You do have a type of judgement... they are judging your behavior until the 18th.
