i was in for 9 months, went thru basic and ait, went to airborne, but when i got to my duty station i left after the first day there. i was gone for about 20 days. i go back to the replacement unit and the co and 1st sgt asked if i wanted to stay in or get out and i told them i wanted out so after that i went tru out processing. but i wasnt suppose to start out processing till i saw the battalion co, but they got me started anyways. i got my medical records, went thru financial, and after about 3 1/2 weeks i finally saw the col. and told me im staying in. but after a few days after that i left. its been a year since that, been arrested, pulled over, and had a police buddy run my name. nothing comes up. i request my records at military archives, but they have no records of my dd214. why is this?

The records center had a fire some years back and a lot of stuff was destroyed. In addition, they have a record of losing things which is why everyone and their uncle warns people leaving the service to have personal records of everything. Big government = mismanagement.

There are situations were the Military will let you leave within 12 months of getting in. It doesn't happen often, usually you have to have a death in the family or some other huge thing that comes up, but basically the Military lets you go with no record. You don't get a honorable discharge or dishonorable. You are entitled to no benefits. You are just out. It is on no public record.

Like I said, it is rare. It only happens if it is within 12 months. And they only really do it if you have been a "good" service member.

You did not go AWOL, you deserted in time of war. This is a federal offensive. If you were just AWOL you would have been gone under one month. Since you are a deserter, you are wanted by the US Marshall Service. If they decide to catch you, you will be tried and convicted. You can receive any sentence from one year and a day to the death penalty. In you receive a sentence in between those I mentioned you will be sent to Fort Leavenworth, KS where the military federal prison is. There you will learn how to make little rocks out of big rocks. Federal time has no parole.

My suggestion is to go back to the post you deserted from and turn yourself in. You may get lucky and get simply a Bad Conduct Discharge. Anyway you look at it you will be better off by returning to the post as soon as possible, from what I hear the Military is looking for its first test of the death penalty for desertion in wartime since PVT. Since you went AWOL and then told them you want out you no longer are a priority to the military.Im sure they have more important things to work on like real SOLDIERS who are still serving their country.My guess you will get your discharge papers sent to you good possibilty not what you really want to see when they arrive.

i would contact you orderly room clerk of your permenant party company they will get the bottom of it. Honestly i would assume that you dd214 is under a big pile of papers still or in a cabinet. Remeber there is a war going on.

Your case probably hasn't been adjudicated yet, you worm! When they get around to you, I'd both advise (and prefer), that you not ever tell anyone you were in my Army. Tell them you a marine if you've got to say anything. Fewer explanations that will only make you look more like a loser.
