Hi !
I just heard about the FICA thing.. does anyone know more about this ? I just want to know if the money will be refunded to us if we are legal immigrant and wish to return to our home country before our retirement ?

No, it will not be refunded. Many countries have tax treaties with the US that prevent double taxation and double benefits.

If you qualify for Social Security in your own right in the US based upon your work record here you may collect it regardless of where you live.

If you don't work here enough to qualify for Social Security here, your country of origin may provide a credit into their system for the wages you earned in the US. That will depend upon the tax treaty with the US and your home nation's laws.

If you worked here on an H1B visa, you were correctly charged FICA. There is no refund available.

(There is a refund available for F1 students who were still in non-resident status when they worked and paid the FICA. This is a similar to a deal all college students get.)

It will be paid to you and benefits along with the half your employer paid plus years of accumulated interest if you get 10 years worth of credit when you reach your full retirement age of somewhere between 66 and 67.
