NO. A tax preparer may NOT legally e-file a return without a W-2 in hand.

While you could technically e-file a return yourself without a W-2 in hand, there is not enough information on a pay stub in most cases to do so. If you got anything wrong on the return you filed you'd have to file an amended return and if that resulted in a higher tax, you'd have to pay it all back by the filing deadline to avoid interest and penalties.

And it's impossible to file a paper return without one except in the rare case where an employer fails to provide one and fails to respond to the IRS requests to provide them for their employees.

It is not legal to file a tax return before you get the proper filing documents. W2's 1099's, etc at this time. You can file with a paystub after Valentine's Day if you do not get a W2 and have made attempts to do so at that point.
