Okay - my brother's ex-fiance just had a baby of which she claims is his, but he is unsure. He thinks she was having an affair when they had a brief break-up.

What are his rights to getting a paternity test? If she applies for child support, will there be an automatic paternity test done? Or does he have to seek it out himself and go to child services (or whatever else they're called) and request a test?

He is really stressed out about it and unsure which path to take. He wants to be a part of this childs life, but he doesn't want to end up paying for a child that could potentially not be his....any help would be fantastic.

I also live in Ohio. His best bet is to go to the local Child Support Agency and request a DNA test. The agency will send summons to both of the parents. Once they both are swabbed. The DNA results will be mailed within 2 weeks. Since this is your brother's ex-fiance this is best because he will not have to pay child support to her until the baby is proven to be his. It might also help to prevent more trouble that could lie ahead if she becomes mean spirited or money hungry and tries using the baby against him. It would also ease his mind, so that if it is his baby he can bond with no doubts but if it isn't he can move on with his life.

He doesn't have to go to court for the DNA test. He just has to call the Mom and arrange for both of them plus the baby to get the test done (lab). They should split the cost. Once it comes back that he is the father, then he can start giving her child support. Your brother MUST KEEP A PAPER TRAIL! He needs a checking account or something similar to keep track of all child support payments. At some point, they can go to court. They don't have to, but most usually do end up there. That is why he needs the proof of prior child support payments. He should not 'just buy her diapers' as that money will never be accounted for. Sorry, too many skanky women cheat the guys especially by refusing to allow visitation and then lying to the judge that he never shows up.

Here in my state the woman can go to the child support office and get it set up; fathers are generally told to get a lawyer.

Have him check with the family court or a court that handles Equity cases. The courts handle so many of these that many courts have forms that can be filled out and filed to initiate a case.

If I was him I wouldn't pay anything to child support without a DNA test confirming he is the father. If they are requesting money have him put that amount aside somewhere just incase the child is his.

Have him keep records of everything!!!!
Especially receipts!!!!!
Never give the mother cash, only checks or money orders (Keep Receipts)!!!!!!

Did he sign the birth certificate? If he did not she cannot apply for child support from him. Is she on welfare? If she is they will want to know who the father could be and they will test for paternity. Is she willing to get the test? If she is he can just get one done. I would make sure that the baby was mine.

I don't rec. prenatal testing unless it is to test for genetic disorders. FYI: Non-Invasive pre-natal testing doesn't work. It is a scheme. That is why they don't offer it in America, only Canada.

Just wait until the baby is born. A test is between 200-300 dollars. If it is not his, the money will be well speant. If it is his, then the peace of mind is worth it.

It can be harmful to do a paternity test before the baby is born.

So, he should demand a test done after the baby is born. especially yes, if she files for support, then he can ask for a test during the court process.
