The employer should pay for that. There is no legal rule/law but I have never seen it any other way.

No legal rule but the employer is the one that wants a back ground check and should be the one that pays for it.

There is no law regarding this specifically. Since there are so many types of background checks and if the employer wants to be very thorough this can be a costly process. However, there are some basic background check options that are very cost effective.
