single car accident, no injuries, no prop damage. snow/ice road conditions. police responded-no citations, no report. just towed car and that was it. went to hospital 5 hours later to make sure no traumatic brain injury, blood/urine tests showed .10BAC can the ins co deny my claim because of a few 'post accident' drinks? new york suff cty

Come on people, he didn't say his car wasn't damaged. He said no injuries or property damage. They don't tow undamaged cars and it was towed.

If you had collision coverage on your policy the insurance will pay for the damages to your car, or if they are extensive, for the fair market value of your car, less any deductible amount of course.

Just stick to your story that the drinks were after the accident and they won't be able to prove anything else, unless they can turn up a witness like a bar tender that will testify you left the bar in bad shape. They WILL investigate.

If there is no injury and no property damage, what would your claim be for? Why would you have thought that you needed to make sure you had no traumatic brain injury if you didn't have pain. "Post-accident" drinks...that's funny. Yes the insurance company can deny any claim by a drunk driver.

To oklatom: He said "no property damage". What is his car but PROPERTY?...duh! In the insurance industry, damage to one's own car is "property damage". Know what you are talking about before you criticize others.

If your car wasnt damaged, you would not need to file a claim. Your regular health insurance will pay for the hospital tests. Since it was five hours after the accident I dont see how they could say you were drinking and driving since there was no ticket or report by the police of a DWI.

Wow, that's legally drunk.

Unless you have an alcohol exclusion, they won't deny the claim. BUT, if you've got medical bills, that's an injury. And if your car got messed up, that's property damage.

That WILL be an at fault accident for you, and your collision deductible will apply.
