Shameful, but... Is it better for my case that I was not actually driving when arrested?

They know that you were driving. That's how you got to where you were. Feeling dizzy means you were above the level of intoxication. You were probably also charged with being in physical control. Speak with an attorney.

My question is were you actually drinking or did you just feel dizzy all of the sudden? It may sound silly, but you need to clarify.

If you were really drinking, really your only defense would be to throw yourself at the mercy of the court. Explain that you felt fine when you left and then started to feel dizzy and pulled over immediately.

Depending on your previous record and if you play your cards right you may get a sympathetic judge that will cut you a break.

No, because you still got behind the wheel.

I think that they can actually give you a DUI if you've sat down in the driver's seat and have the key in hand. Because they have probably cause to think that you were going to drive under the influence.

Not really, since you have to have been driving at some point to pull over on the I-5, and you didn't just start drinking on the shoulder.

if your car was running or the keys were in the vehicle then you are guilty of DUI in there eyes. There is no other way to prove that you didn't drive which you did. Just go in plead guilty and hope for a small fine...

Your prime defense should be since you were not driving the vehicle and had pulled over it was from the fact when you started the vehicle you were not driving intoxicated however as you continued driving home your body metabolized more alcohol which then put you past the legal limit and you immediately pulled over. And explain seeing no recourse for leaving your vehicle on the side of the highway illegally you choose to wait till you were legally capable of driving your vehicle home which would have been after the cops found you on the side of the road.

Around here they say that if the keys were in the ignition you were operating the motor vehilce...

even if you in drive way or parked and smoking in the hot air when it is cold out side.

It may be better for your case that you weren't driving, but they can make a case, what if you would wake up and have a black out, then start driving.

100 years of DUI history and you think your case hasn't happened a million times before?

You have nothing new to add. be prepared to lose your license for a while and pay skyhigh insurance rates after that.
